Open Software Public License (OSPL)

Projects like Abora and Praxis use OSPL, a source-available community license that encourages community contributions and content creators while restricting military use. OSPL is more permissive than FSPL for YouTubers, streamers, and educational content creators. Note: Due to the military-use prohibition, OSPL does not qualify as an OSI-approved open source license.

PREAMBLE

This Open Software Public License promotes open collaboration, community contribution, and content creation while protecting against military misuse. Source code is freely available for all lawful purposes, and creators are encouraged to build, share, and monetize content using these projects.

"License" refers to this Open Software Public License (OSPL).

"Licensor" means AnimatedGTVR and Xeno Tech.

"Software" means the source code, object code, and documentation provided under this License.

"You" means any individual or legal entity exercising rights granted by this License.

"Derivative Works" means any modification, adaptation, or transformation of the Software.

"Distribute" means to make the Software available to third parties.

2. GRANT OF RIGHTS

Subject to Section 5 (Military Prohibition) and all other terms of this License, Licensor grants You a non-exclusive, worldwide, royalty-free license to use, modify, distribute, and create derivative works of the Software for any lawful purpose.

3. PERMITTED USES

• Personal, educational, and research use without restriction

• Creating and sharing video content, streams, tutorials, and educational material

• Monetizing content (YouTube ad revenue, Twitch subscriptions, sponsorships) featuring the Software

• Commercial use of modifications, provided source code remains open

• Creating forks and community editions with clear, distinct naming

• Use of logos and branding solely for commentary, education, review, demonstration, news reporting, and content creation relating to the Software

4. RESTRICTIONS

You may not:

• Remove or obscure copyright and license notices

• Rebrand and resell unmodified software as a standalone product

• Claim trademark ownership of "Xeno Tech," "Abora," or "Praxis"

• Distribute proprietary/closed-source versions without written permission

5. MILITARY USE PROHIBITION

The Software may not be used directly or indirectly by military organizations, defense contractors, weapons manufacturers, military intelligence entities, combat systems, military research programs, private military contractors, or any entity involved in military operations, weapons development, or weaponization.

6. DERIVATIVE WORKS

Derivative Works must retain this License, include attribution, and make source code available under this License. You may create forks and community editions with distinct names (e.g., "Community Abora" or "Praxis Fork").

7. TRADEMARK SEPARATION

The Software is licensed under this License. Trademarks, logos, artwork, mascots, and branding remain the property of Licensor and are not transferred by this License. Logo use in educational and non-commercial content is permitted under Section 3; however, all trademark rights remain exclusively with Licensor.

8. PATENT LICENSE

Licensor grants You a non-exclusive, worldwide, royalty-free patent license for any patents necessarily infringed by Your authorized use of the Software. Any party initiating patent litigation against Licensor regarding the validity or enforceability of this License automatically loses all rights granted under this License, and all license grants terminate immediately.

9. TERMINATION

Any violation of Sections 4 (Restrictions) or 5 (Military Prohibition) automatically terminates all rights granted herein. Your rights may be restored once the violation is corrected and reasonable time has passed. Upon termination, You must cease all use and distribution of the Software.

10. WARRANTY DISCLAIMER

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT.

TinyPM uses FSPL, a balanced open source license that protects commercial interests while encouraging community contribution and restricting military use.

This Fair Source Public License promotes open collaboration and community contribution while protecting fair commercial use and trademark rights. Source code is publicly available for learning, auditing, and contributions, but commercial rebranding and resale are restricted.

"Licensor" means AnimatedGTVR and Xeno Tech.

"Software" means the source code, object code, and documentation.

"You" means any individual or entity.

"Derivative Work" means any modification, adaptation, translation, or transformation of the Software.

"Proprietary Components" means any file, service, repository, asset, plugin, module, API, dataset, artwork, logo, trademark, or component explicitly designated by Licensor as PROPRIETARY, PRIVATE, CLOSED, ENTERPRISE, or otherwise excluded from this License.

"Code and Branding" are governed separately under this License. This License applies only to the Software code. Trademarks, logos, branding, artwork, mascots, and brand assets are not licensed under this License unless explicitly stated in writing.

2. GRANT OF RIGHTS

Subject to the terms of this License, Licensor grants You a non-exclusive, worldwide, royalty-free license to:

a) Use the Software for personal, educational, and internal business purposes.

• Circumvent or disable any technical protection measures

• Host Proprietary Components on public infrastructure without written consent

5. DERIVATIVE WORKS & FORK NAMING

Any Derivative Work you create and distribute must:

• Retain this License or a compatible open source license

• Include clear attribution to the original Software and Authors

• Document all modifications made

• Make source code available to recipients

• Not use Xeno Tech trademarks or branding without permission

• Use a clearly distinct name that does not cause confusion with the original project. Names like "Abora Enterprise Community Edition" or "SuperAbora" are prohibited without written permission.

6. TRADEMARK RIGHTS & LOGO USAGE

You do not receive any rights to Xeno Tech trademarks, logos, brand names, or artwork. However, logo and trademark usage is permitted in the following cases:

Permitted Logo Use (No Permission Required):

• Creating video content, tutorials, or educational material about Xeno Tech projects (Abora OS, Praxis, TinyPM, etc.)

• Demonstrating or showcasing the Software in non-commercial media

• Reference and attribution in documentation or academic materials

Commercial Logo Use (Permission Required):

• Using logos for commercial promotion, marketing, or merchandise for your own business or product

• Creating monetized content (ad-supported videos, sponsored content, etc.) that prominently features Xeno Tech branding

• Commercial products or services that use Xeno Tech logos or trademarks as primary branding

7. DISCLAIMER OF WARRANTY

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. b) You do not rebrand or misrepresent the Software as your own;

d) Proprietary Components remain proprietary to Licensor;

e) Your use does not support or facilitate military operations or military purposes;

f) Your use complies with all applicable laws and does not violate third-party rights;

g) Commercial products are clearly marked as incorporating Xeno Tech Software.

11. MILITARY USE RESTRICTION

The Software may not be used directly or indirectly by military organizations, defense contractors acting on behalf of military organizations, weapons manufacturers, combat systems, military intelligence activities, weapons research, military operations, or any entity involved in weaponization. This includes use by private military contractors and their affiliates.

12. PATENT PROTECTION

Licensor grants You a non-exclusive, worldwide, royalty-free patent license for any patents necessarily infringed by Your authorized use of the Software.

Any party initiating patent litigation against Licensor regarding the validity or enforceability of this License automatically loses all rights granted under this License, and any license grants terminate immediately.

13. CONTRIBUTION LICENSE AGREEMENT

By submitting a contribution to the Software, You grant Licensor the right to use, modify, distribute, sublicense, and relicense that contribution as part of the Software under this License or any future compatible license. You represent that You own or have authority over such contributions.

14. SEPARATE CODE AND BRANDING

This License applies only to the Software code. Trademarks, logos, branding, artwork, mascots, and other brand assets are not licensed under this License unless explicitly stated in a separate written agreement. All trademark and brand rights remain with Licensor.

15. GOVERNING LAW

This License shall be governed by the laws of the State of Indiana, United States, and the parties consent to the exclusive jurisdiction of the courts located therein.

16. ENTIRE AGREEMENT

This License constitutes the entire agreement between Licensor and You regarding the Software. No modifications or amendments are valid unless in writing and signed by both parties.
